Gov’t speeds up enforcement of Law on Enterprises, Investment
Accordingly, the Government asks the Ministry of Planning and Investment (MPI) to complete a draft Decree guiding the realization of the Law on Enterprises and Law on Investment and coordinate with the Government Office to complete procedures for issuance before September 15, 2015.
Ministries of Justice, Planning and Investment, Construction, Natural Resources and Environment, Finance, provinces and cities are asked to review and evaluate the enforcement of regulations on investment procedures, land, planning, construction, and environment as stipulated in Decree No. 43/NQ-CP dated June 6, 2014 and propose amendments in order to reduce time required for processing these procedures. The MPI will synthesize the proposed amendments before December 15, 2015 and report to the Prime Minister.
The Ministry of Industry and Trade (MoIT) will mull over amendments to the current regulations on granting Business Licenses and licenses for establishment of retail activities by foreign-funded enterprises in Viet Nam as stipulated in Decree 23/2007/ND-CP dated February 12, 2007.
The Ministry will also be responsible for submitting a roadmap for activities of purchase and sale of goods and activities directly related to the purchase and sale of goods in accordance with Viet Nam’s international commitments.
Relevant ministries and agencies will have to strengthen dissemination of the regulations of these two laws among the business community and investors and organize training courses to increase the professional skills of officials and civil servants who are in charge of processing administrative procedures.
The Law on Enterprises and the Law on Investment take effect since July 1, 2015.
These laws have created crucial legal foundation to ensure the implementation of the Constitution regarding the freedom of business for citizens in the domains that are not prohibited, simplify administrative procedures and shorten the required time for setting up a new enterprise, granting Investment Certificate for foreign investors./.
