Fresh regulations on recruitment of Vietnamese workers by foreign organizations in Viet Nam
The Government has promulgated Decree No. 371/2026/ND-CP detailing the recruitment and management of Vietnamese workers employed by foreign organizations and individuals in Viet Nam.

Decree 371 regulates the recruitment and management of Vietnamese workers employed by foreign organizations and individuals in Viet Nam pursuant to Clause 3, Article 150 of the Labor Code No. 45/2019/QH14.
Regulations for foreign organizations to recruit employees
Subjects not allowed to work for foreign organizations
Foreign organizations and individuals must notify the competent managing agency of recruitment needs and publicly post vacancies on the National Employment Exchange or another lawful employment platform/official website.
Employers may recruit workers directly or request assistance from competent Vietnamese agencies in selecting and recommending candidates.
Employers must notify the competent agency within 10 working days after signing an employment contract, providing the worker's identification, position and start date.
Employers must notify the competent agency within 10 working days after terminating a contract, while the agency must confirm the end of management and return the worker's dossier within 3 working days.
The rules cover Vietnamese workers employed by foreign diplomatic missions, consular offices, international organizations, foreign-government organizations, foreign media offices and foreign NGOs, among others.
Decree 371 takes effect from November 15, 2026, replacing the relevant provisions of Decree 152/2020/ND-CP, as amended by Decree 70/2023/ND-CP.
On April 14. the Ministry of Home Affairs officially inaugurated the National Employment Exchange, available at www.vieclam.gov.vn. The digital platform is designed to connect over 53 million workers with businesses, employment service organizations, and state management agencies nationwide, aiming to foster a modern, transparent, flexible, and efficient labor market./.
